Texas lease setup checklist.

Texas required steps

• Confirm the security deposit cap

  No statutory cap (Tex. Prop. Code § 92.103).

• Set a lease-compliant late fee

  Must be reasonable; safe harbor at 12% (≤4 units) / 10% (>4 units) with 2-day grace Allow a 2-day grace period.

• Plan entry-notice language

  Give at least 24 hours' notice before entering, absent an emergency.

• Set month-to-month termination notice

  30 days (month-to-month).

• Attach every required disclosure

  Lead-based paint, Landlord/agent identity, Tenant rights (parking, towing), Special flood hazard (since 2022), Smoke alarm rights.

• Plan deposit return timing

  30 days (Tex. Prop. Code § 92.103).

• Collect state-specific lease fields

  In 100-year floodplain?, In 500-year floodplain?, Prior flood damage in last 5 years?.
