New York required steps
Confirm the security deposit cap
1 month's rent (HSTPA 2019) (N.Y. Gen. Oblig. Law § 7-108(1-a)).
Set a lease-compliant late fee
Capped at $50 or 5% of monthly rent (whichever is less); 5-day grace required Allow a 5-day grace period.
Plan entry-notice language
Give at least 24 hours' notice before entering, absent an emergency.
Set month-to-month termination notice
30/60/90 days (based on tenancy length).
Attach every required disclosure
Window guards (NYC), Bedbug (NYC), Sprinkler, Lead-based paint, Good Cause Eviction notice (where applicable), Flood risk (since 2023), Indoor allergen hazards (NYC), Gas leak procedures (NYC), Smoke/CO detector, Owner's contact.
Plan deposit return timing
14 days with itemized statement (N.Y. Gen. Oblig. Law § 7-108(1-a)).
Collect state-specific lease fields
HPD Registration Number, Rent-stabilization status, RS rider attached?.
